This Privacy Policy describes how Eieyani Capital Associates (“ECA,” “we,” “us,” or “our”) collects, uses, stores, and handles information when you visit our website or submit information through our intake form. By using the Site, you acknowledge that you have read and understood this Privacy Policy.

1. Information We Collect

1.1 Information You Submit Directly

When you submit the preliminary intake form on or linked from the Site, we collect information you provide, which may include:

•  Business name and contact information (name, email, phone number)

•  Business financial information (gross revenue, EBITDA estimates, existing debt totals)

•  Business operational details (industry, years in operation, legal entity type)

•  Financing request details (funding amount, intended use of capital)

Submitting this information does not constitute a formal loan application, a hard credit pull, or a binding engagement of ECA’s services. See Section 3 of the Terms of Service for further detail.

1.2 Information Collected Automatically

When you visit the Site, we may automatically collect certain technical information, including:

•  IP address and approximate geographic location

•  Browser type, operating system, and device information

•  Pages visited, time spent on pages, and referring URL

•  Cookies and similar tracking identifiers (see Section 5 below)

2. How We Use Your Information

ECA uses the information we collect for the following purposes:

•  To perform preliminary deal evaluation, including DSCR and leverage testing, using our proprietary internal software and modeling tools, on submitted financial data

•  To determine whether a submitted opportunity may be suitable for ECA’s brokerage services

•  To contact you regarding your inquiry, if applicable

•  To improve the Site and understand how visitors use it

•  To comply with legal, regulatory, and recordkeeping obligations

ECA does not use submitted financial or business information for marketing, advertising, or any purpose unrelated to evaluating your financing inquiry.

3. How We Share Your Information

3.1 ECA does not sell personal or business information to third-party lead generators, data brokers, or marketing platforms.

3.2 If ECA proceeds with a financing engagement following intake, financial and business information may be shared with prospective capital sources (private credit funds, family offices, and similar institutional or private lenders) in accordance with ECA’s tiered disclosure process: first on an anonymized basis, and then in full only after a non-disclosure/non-circumvention agreement is executed between ECA and the applicable capital source. This process is governed by ECA’s Broker Representation Agreement, which is executed separately from and subsequent to the intake form submission.

3.3 ECA may share information with third-party service providers who assist in operating the Site and its internal processes (including Google Workspace for data storage and communication), solely for the purpose of delivering those services. These providers are not authorized to use your information for their own independent purposes.

3.4 ECA may disclose information if required by law, regulation, court order, or governmental request, or where disclosure is necessary to protect the rights, property, or safety of ECA or others.

4. Use of AI Tools in Data Analysis

ECA may use artificial intelligence and large language model tools to assist in synthesizing, summarizing, or analyzing submitted financial information for internal deal evaluation purposes. Where AI tools are used in connection with submitted data, ECA takes reasonable steps to redact or omit personally and entity-identifying information prior to processing, and uses tools with business-level data handling settings where available. Human oversight is maintained over all outputs and decisions. ECA’s use of AI tools does not alter the nature of the intake submission or create any additional commitment or obligation on ECA’s part.

5. Cookies and Tracking Technologies

The Site may use cookies and similar technologies to operate and improve its functionality. These may include:

•  Essential cookies: required for basic site functionality

•  Analytics cookies: help us understand how visitors interact with the Site so we can improve it

You can manage or disable cookies through your browser settings. Disabling essential cookies may affect the functionality of the Site. ECA does not currently use cookies for advertising or cross-site tracking.

6. Third-Party Processing

The intake form is hosted or processed through Google Forms and Google Workspace. By submitting the intake form, your data is processed in accordance with Google’s own privacy practices in addition to this policy. ECA encourages you to review Google’s Privacy Policy at policies.google.com. ECA is responsible for how it uses data it receives from Google Forms; Google is responsible for how it processes data on its own infrastructure.

7. Data Security

ECA takes reasonable administrative and technical measures to protect the information we collect against unauthorized access, disclosure, alteration, or destruction. These measures include access controls, use of encrypted communication channels (where applicable), and limiting data access to personnel directly involved in deal evaluation. No method of electronic transmission or storage is completely secure, and ECA cannot guarantee absolute security of information.

8. Data Retention

ECA retains submitted information for as long as reasonably necessary to evaluate the inquiry, maintain records of business activity, and comply with applicable legal and tax obligations. Intake submissions that do not result in an engagement may be retained for a reasonable internal review period, after which they are deleted or de-identified. 9. Your Rights

Depending on your jurisdiction, you may have rights regarding your personal information, including the right to access, correct, or request deletion of information ECA holds about you. To exercise any of these rights, please contact ECA directly. ECA will respond to reasonable requests in a timely manner, subject to applicable legal and recordkeeping obligations.

10. Children’s Privacy

The Site is not directed to individuals under the age of 18. ECA does not knowingly collect personal information from minors. If ECA becomes aware that it has collected information from a minor, it will take steps to delete that information promptly.

11. Changes to This Policy

ECA may update this Privacy Policy from time to time. Updated versions will be posted to this page with a revised effective date. Continued use of the Site following any update constitutes acceptance of the revised policy.
